They meet with Wayne's wife and she says she doesn't communicate much with him. They then talk to Wayne's son Will. He says he doesn't hear from his dad, but he told him everything was going to work out. Wayne's wife offers to send an email to Wayne saying Will is injured in order to trick him into coming out of hiding.
The detectives wait at the hospital disguised as EMTs. Roger arrives and says he is there as Wayne's attorney.
Anita wonders how Roger knew about the sting. They find out Will tipped him off. Will's mom says Will lived with Wayne over the summer. Cyrus and Kevin then go to Wayne's residence and meet with Wayne's girlfriend. They find a computer and see Wayne crawling out of a window. Kevin tackles him and puts him under arrest.
Michael and Connie discuss a deal with Roger and Wayne, but are unable to reach an agreement. Roger tells Wayne it is time for him to take a stand. Wayne says he had to stop Benning from committing murder. Roger says Wayne was protecting others from being murdered.
Roger and Michael meet with the judge and Roger tells her Wayne was preventing the murder of a baby. Roger says Ehlers-Danlos syndrome is a survivable condition. The judge allows Roger to present a justification defense. Michael tells her she is opening up a pandora's box.Michael and Connie meet with Jack. Michael admits an unborn fetus is a baby to him, but he will revert his language in the course. Jack says they need to prove Wayne intended to kill Benning before he ever knew about Blair's baby.
Connie meets with a nurse at Benning's clinic and finds she now works at a neonatal ward. The nurse explains that Benning attempted a late term abortion for a woman named Howell, but the baby was born alive. He asked Ms. Howell if she wanted him to complete the procedure and she said yes. The nurse says when Benning terminated the baby, she knew she couldn't go back there.
Connie meets with Ms. Howell and tells her about Benning's murder. She asks how Connie knew about her medical history. She tells Connie to leave her alone.
Connie tells Jack and Michael about the infant's murder and realize they need to turn it in. Michael says it isn't relevant to their trial and they should wait to report the crime.
Kevin takes the stand and says he tried to ask Benning not to abort his grandchild, but met Wayne instead. Kevin says Wayne told him his grandson would be okay and he understood that to mean the abortion would not take place. Kevin says he is not anti-abortion, but he knew Blair's baby had a survivable condition. Michael calls another doctor to the stand and he says the responsible choice would have been to abort Blair's baby. Roger cross examines and gets the doctor to call pro-lifers hypocrites and fools.
A woman named Lisa Barnett takes the stand and explains how Benning recommended she have a late term abortion. She says she decided she wanted her baby's death to be natural. She says her baby wasn't a monster when she was born. She explains that the night after she was born, she slipped away. She adds that she never regretted her decision not to abort her daughter. Michael asks if she considers doctors like Benning as providing an essential service and she says yes.
Michael and Jack talk about how the jury was in tears. Jack reminds Michael the jury could still acquit. Michael says Roe v Wade is outdated because of new medical advances. Jack tells Michael he will not cut a deal with Wayne. They then find out Janine, the nurse at the botched abortion, is going to take the stand. Jack tells Michael he thinks he leaked her name. Connie walks in and says she was the one who reported her.
Connie and Michael tell the judge that if Janine takes the stand, it will violate the patient's confidentiality. The judge says they will refer to the patient as Jane Doe and allows Janine to take the stand. Janine describes the botched abortion and how Benning stabbed the baby in the head with his scissors and discarded it as medical waste. Michael asks Janine how long the baby would have survived and Janine says a day or two at most.
Michael and Connie argue about leaking Janine's story. Connie says she grew up believing Roe v Wade was gospel, but she broke after hearing Lisa's story. Michael tells her she needs to do her job and put the bad guys in jail. She tells him she can't leave her soul behind when she goes to work.
Roger shows the jury a picture of Daniel, Blair's recently born baby. Michael shows the jury photos of Benning's children that he carried in his wallet. Michael then stops and says he can't continue. He says they are dealing with the issue of determining what is life. He says they all want to do the right thing and value life. He says they all want to reject violence, including the act that Wayne committed against Benning. The jury returns with a guilty verdict.
Jack tells Michael that Connie asked to be transferred to the white collar crime bureau. Michael says it's fine with him, but Jack says it's not okay with him. He says it's a messy world and tells them to work it out.
