A criminal named Jeremy Kent says that he was never allowed to tell his side of the story. He says that his cellmate told the prosecutors that he murdered a man in exchange for a lesser sentence. He says that his attorney told him not to take the stand. Kent lost his case and went to jail. He says that he learned that his cellmate's lawyer was his own attorney, the late Benjamin Tripp. He tells the court that his attorney had a conflict of interest and he deserves a new day in court.

Catherine says that in 1991 she investigated the murder that Kent was convicted of. She says that a rock was thrown through the window and used to break in the house. She says that the standards of investigation were different than today. Catherine brings the CSI team to the murder scene. She says that a witness saw Jeremy Kent at the scene from a half a mile away. She tells Nick that she found Kent's fingerprint on the rock. Catherine says that she believes that Kent tried to rob the house, but it went bad. She says that the elderly victim, Mr. Harrot was still at the home during the robbery and was killed. She says that the murder weapon was never found, but Harrot appeared to be killed by a hammer.

The show flashes back to 1991. Mr. Harrot calls 911 and reports someone entering his house. Back in the present time, Archie and Greg listen to the tape. Archie says that the police found the phone off the hook when they arrived. Archie says that audio technology has improved since 1991. They hear a car engine in the background. Archie says that he is going to try to find a vehicle that matches the sound.

Ray and Al examine Harrot's autopsy report. They see that the investigators determined that Harrot fell and was hurt on both sides. They see that Harrot was actually beaten then killed.

Catherine meets with Kent. Kent learns that his case was Catherine's first unsupervised case. He says that he heard that her late husband was a drug user. He asks if she was using drugs at the time and she says no. Kent tells Catherine that he doesn't trust her lab results.

Riley and Wendy examine the bloody rug from Harrot's murder scene. They find an imprint of a hammer.
